NOTICE OF PUBLIC HEARINGS AT JUNE 17, 2026 HASTINGS-RUTLAND JOINT PLANNING COMMISSION MEETING
Please take notice the Hastings-Rutland Joint Planning Commission will hold two public hearings at its regular meeting on June 17, 2026, at 5:30 PM, at the Rutland Charter Township Hall/offices located at 2461 Heath Road, within the Charter Township of Rutland, Barry County, Michigan, as follows:
- The request of Meijer, Inc. to amend the Zoning Map made part of the Zoning Ordinance of the Hastings-Rutland Joint Planning Commission to include parcel number 13-014-028-00 comprising a land area of approximately 31.79 acres, commonly known as 420 North Tanner Lake Road, to be within the jurisdictional area of the Joint Planning Commission (JPC) for zoning purposes in accordance with controlling statutes and proposed agreements between Rutland Charter Township and the City of Hastings. The subject property is presently zoned MU-Mixed Use District under the Rutland Charter Township Zoning Ordinance/Zoning Map, and is proposed to have the same zoning classification under the Zoning Ordinance/Zoning Map of the Hastings-Rutland JPC. The subject property comprises a proposed “4th Urban Services District” the Township and City are proposing to create pursuant to a proposed Urban Services and Economic Development Agreement.
Subsequent to this public hearing, either at the same meeting or at a different meeting, the JPC will consider whether to recommend approval of the proposed Zoning Map amendment and submit same for approval by the Rutland Charter Township Board and Hastings City Council, each of which by statute and agreement have the right of final approval and adoption of the resulting proposed joint ordinance. The JPC and Township Board/City Council reserve the right to revise the proposed Zoning Map amendment as submitted for public hearing and/or as recommended by the JPC before final approval/adoption, to the extent allowed by law. Approval of the proposed Zoning Map amendment by the Township Board and City Council will be subject to the underlying proposed Urban Services and Economic Development Agreement becoming fully effective.
- The application of Meijer, Inc. for approval of a special land use permit for the following three land uses associated with the proposed primary use of the subject property as a Meijer Supercenter:
- greenhouse/nursery/landscaping/garden shop, which is designated as a special land use in the MU-Mixed Use District pursuant to Section 6.03.A.4. of the Zoning Ordinance of the Hastings-Rutland Joint Planning Commission.
- open-air business, which is designated as a special land use in the MU-Mixed Use District pursuant to Section 6.03.A.5. of the Zoning Ordinance of the Hastings-Rutland Joint Planning Commission.
- refueling station/convenience store, which is designated as a special land use in the MU-Mixed Use District pursuant to Section 6.03.A.16. of the Zoning Ordinance of the Hastings-Rutland Joint Planning Commission.
The Joint Planning Commission will consider this application pursuant to the standards for approval of a special land use specified in Section 10.04 of the Zoning Ordinance of the Hastings-Rutland Joint Planning Commission, and any other applicable provisions of that Ordinance. If the Joint Planning Commission approves or approves with conditions the special land use permit application at this meeting, or at a subsequent meeting, the JPC will also review and consider for approval a related site plan for the proposed development of the subject property as a Meijer Supercenter with the above-indicated accessory uses, pursuant to the standards for site plan approval specified in Section 9.04 of the Zoning Ordinance of the Hastings-Rutland Joint Planning Commission, and all other applicable provisions and requirements of that Ordinance.
Any and all approvals by the Joint Planning Commission of the application for special land use permit and the related site plan will be subject to the condition that the underlying Urban Services and Economic Development Agreement creating the 4th Urban Services District becomes effective, the condition that the underlying zoning of the subject property to the MU-Mixed Use District under the Zoning Ordinance/Zoning Map of the Hastings-Rutland Joint Planning Commission is approved by the Hastings City Council and Rutland Charter Township Board and becomes effective, and such other conditions as the Joint Planning Commission may lawfully impose on approval of the special land use permit and/or site plan pursuant to applicable provisions of the Michigan Zoning Enabling Act and the Zoning Ordinance of the Hastings-Rutland Joint Planning Commission.
A map showing the above-referenced property proposed to be included under the zoning jurisdiction of the JPC Zoning Ordinance/Zoning Map, and for which Meijer, Inc. is requesting special land use permit and site plan approvals, and the legal description of same, may be examined by contacting the Clerk of the City of Hastings or the Clerk of Rutland Charter Township at their respective offices during regular business hours on regular business days until and including the day of the hearing/meeting, and further may be examined at the hearing/meeting.
Written comments concerning any of the above-referenced matters may be submitted to the JPC in c/o the Hastings City Clerk at any time prior to this public hearing/meeting leaving sufficient time for the receipt and distribution of same to the JPC before the meeting, and may also be submitted to the JPC at this public hearing/meeting.
Necessary reasonable auxiliary aids and services will be provided at the hearing/meeting to individuals with disabilities, such as signers for the hearing impaired and audiotapes of printed materials being considered, upon reasonable notice to the Rutland Charter Township Clerk. Individuals with disabilities requiring auxiliary aids or services should contact the Rutland Charter Township Clerk.
